These Terms of Service govern your use of RecruFY. Please read them carefully. By accessing or using the platform, you agree to be bound by these Terms.

1. Acceptance of Terms

These Terms of Service (the "Terms") constitute a legally binding agreement between you and [შპს რეკრუფაი/RecruFY], a company registered in Georgia under identification number [REGISTRATION ID], with its registered address at [REGISTERED ADDRESS] ("RecruFY", "we", "us", or "our"), governing your access to and use of the recrufy.ge website, applications, and related services (collectively, the "Services").

By creating an account, accessing, or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Services.

2. Definitions

  • "Company" or "Employer" means a business account that posts vacancies, invites candidates, and uses assessments.
  • "Candidate" or "Applicant" means an individual account that takes assessments, applies to positions, and explores their results.
  • "Assessment" means any test, quiz, or psychometric instrument available on the platform.
  • "Survey" means a questionnaire created using the RecruFY Surveys product to collect responses.
  • "Content" means any data, text, results, or materials submitted to or generated by the Services.
  • "User" means any person who accesses the Services, including Companies and Candidates.

3. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Services. By using the Services, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.

If you are using the Services on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

4. Accounts & Registration

To access certain features, you must register for an account and provide accurate, complete, and current information. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.

You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss arising from your failure to protect your credentials. You may not share, sell, or transfer your account to any third party.

5. Description of Services

RecruFY is a hiring and assessment platform that connects companies with candidates through skills-based evaluation. The Services include, among other features:

  • Publishing and managing job vacancies;
  • Administering assessments and reviewing candidate results;
  • Taking assessments and applying to positions;
  • Creating surveys and collecting responses;
  • Analytics, dashboards, and related tools.

We may add, modify, or discontinue any part of the Services at any time. We strive to maintain availability but do not guarantee uninterrupted access.

6. Terms for Companies

Companies may post vacancies, invite candidates, and require assessments as part of their hiring process. By using these features, you agree that:

  • You will use candidate data only for lawful recruitment purposes and in compliance with applicable data-protection law;
  • You will not use assessment results to discriminate unlawfully against any candidate;
  • Job postings will be accurate, lawful, and for genuine opportunities;
  • You are responsible for your own hiring decisions, which RecruFY does not make on your behalf.

7. Terms for Candidates

Candidates may take assessments, view their results, and apply to positions. By using these features, you agree that:

  • You will complete assessments honestly and without external assistance or cheating;
  • The information you provide in your profile and applications is accurate;
  • You understand that taking an assessment does not guarantee employment;
  • You consent to your results being shared with Companies to whose positions you apply, as described in our Privacy Policy.

8. Assessments & Results

Assessments are provided as tools to support evaluation and self-discovery. While we strive for validity and reliability, assessment results are indicative and should not be treated as definitive measures of ability, character, or suitability.

You agree not to copy, record, redistribute, or publish assessment questions or content. Attempting to manipulate, cheat, or game any assessment is strictly prohibited and may result in invalidated results and account termination.

9. Surveys

The RecruFY Surveys product allows users to create questionnaires and collect responses. As a survey creator, you are solely responsible for the content of your surveys and for complying with all applicable laws regarding the collection and processing of respondent data, including obtaining any necessary consents.

You must not use Surveys to collect data unlawfully, to harass, or to distribute prohibited content. You are the data controller for responses you collect; RecruFY acts as a data processor on your behalf as described in the Privacy Policy.

10. Payments & Subscriptions

Certain features require payment. Prices are displayed in Georgian Lari (GEL) unless stated otherwise and may be subject to applicable taxes. By subscribing to a paid plan or making a purchase, you authorize us (and our payment processors) to charge the applicable fees.

Subscriptions renew automatically at the end of each billing period unless cancelled before renewal. One-time purchases are charged once at the time of purchase. We reserve the right to change our prices, with notice for active subscriptions.

11. Refunds & Cancellation

You may cancel a subscription at any time; cancellation takes effect at the end of the current billing period, and you will retain access until then. [INSERT YOUR REFUND POLICY — e.g. whether/when refunds are available, cooling-off period, etc.]

Where required by Georgian consumer-protection law, statutory rights to withdrawal or refund will apply and are not affected by this section.

12. Acceptable Use

You agree not to:

  • Use the Services for any unlawful, fraudulent, or harmful purpose;
  • Attempt to gain unauthorized access to any system, account, or data;
  • Upload malware, scrape data without permission, or disrupt the Services;
  • Impersonate any person or misrepresent your affiliation;
  • Infringe the intellectual property or privacy rights of others;
  • Reverse-engineer or copy any part of the platform.

13. Intellectual Property

The Services, including all software, design, text, graphics, logos, and assessment content, are owned by RecruFY or its licensors and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Services for their intended purpose.

You retain ownership of content you submit, but grant RecruFY a license to host, process, and display it as necessary to provide the Services.

14. Third-Party Services

The Services rely on third-party providers, including hosting and database infrastructure (Supabase), deployment (Vercel), and payment processing. Your use of the Services may be subject to those providers' terms. We are not responsible for the acts or omissions of third-party providers.

15. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that assessment results will be accurate or fit for any particular decision.

16. Limitation of Liability

To the maximum extent permitted by Georgian law, RecruFY shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Services.

Our total aggregate liability for any claim arising out of these Terms or the Services shall not exceed the amount you paid to us in the [INSERT PERIOD — e.g. twelve (12) months] preceding the event giving rise to the claim.

17. Indemnification

You agree to indemnify and hold harmless RecruFY and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Services, your violation of these Terms, or your infringement of any third-party rights.

18. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if you breach these Terms or if we reasonably believe your use poses a risk to the platform or other users. You may terminate your account at any time by contacting us or using the account-deletion features.

Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) shall survive.

19. Governing Law & Disputes

These Terms are governed by the laws of Georgia, without regard to conflict-of-law principles. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of [INSERT CITY — e.g. Tbilisi], Georgia, unless otherwise required by mandatory consumer-protection law.

20. Changes to These Terms
